What the 5108 is for
The Medical Condition Report tells the Registrar of Motor Vehicles that a patient has, or appears to have, a condition that may make it dangerous to drive. It covers both reports the Highway Traffic Act requires and reports it permits. MTO’s Driver Medical Review Office decides what happens to the licence.
The 5108 is for physicians, nurse practitioners and occupational therapists. Optometrists report vision on a separate form, the 5109 Vision Report. In every case, you must have met the patient for an examination or to provide care.
Who completes it
The reporting practitioner completes every part. Physicians and nurse practitioners make mandatory reports. Physicians, nurse practitioners and occupational therapists can make discretionary reports. The patient completes nothing, though page one asks whether they know about the report.
How to fill in the report
Part 1, Patient Information
Enter the name, date of birth, gender and address, and the driver’s licence number if you have it. The name and date of birth carry onto page two automatically when you fill in page one.
Part 2, Practitioner’s Information
Give your licence number, address and your relationship to the patient. Answer the three questions: whether the patient is aware of the report, whether MTO may release it to them, and whether you want notice if they ask for it. Sign and enter the examination date, which is mandatory.
Part 3, Medical Condition or Impairment
This lists the six mandatory categories: cognitive impairment, sudden incapacitation, motor or sensory impairment, visual impairment, substance use disorder and psychiatric illness. Each has its own list, such as obstructive sleep apnea with an AHI of 30 or more and daytime sleepiness, or hypoglycaemia needing third-party help. MTO’s guide says every condition in this part warrants a suspension, so tick one only when the patient meets the printed definition.
Part 4, Discretionary Report
Use this box when the condition isn’t one of the listed mandatory ones but, in your opinion, may make driving dangerous. Describe the condition and its effect on driving: episodes, frequency, recent events, and what you observed.
Common reasons it’s delayed
- Mandatory fields, marked with an asterisk, left blank. MTO can’t process an incomplete report.
- Only page one faxed. The form is two pages, and both must arrive.
- A mandatory box ticked for a condition that doesn’t meet the printed definition, when a discretionary report was meant.
- No examination date, or no practitioner signature.
- The same report faxed and then mailed, which creates a duplicate.
Submitting and who pays
Complete the form electronically, print it, sign it, and fax both pages to the Driver Medical Review Office, or mail them to the address printed on the form. Some clinics can submit through eForms instead. The form prints OHIP fee code K035 for the report.
